These Terms govern your use of the MyDay service (the "Service") provided by MyDay("we", "us"). By creating an account or using the Service, you agree to these Terms.
Acceptance
By continuing to use the Service you confirm that you have read, understood, and accepted these Terms. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation.
The Service
MyDay is a web and mobile application that helps families and support organisations build daily routines and a personalised picture-symbol communication board for children with autism and additional learning needs.
Your account
You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity that happens under your account.
Acceptable use
You agree not to:
- use the Service for any unlawful purpose, fraud, spam, or harassment;
- infringe any third party's intellectual property or privacy rights;
- upload malware or interfere with the security or integrity of the Service;
- probe, scan, scrape, or reverse engineer any part of the Service.
Intellectual property
We retain all rights, title, and interest in the Service, including its software, design, branding, and documentation. You retain ownership of any photos, names, or other content you upload, and you grant us a limited licence to host and process that content solely to provide the Service.
Subscriptions, payment and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for more.
Service level
We work hard to keep MyDay running smoothly but cannot guarantee that the Service will be uninterrupted or error-free. We disclaim all implied warranties to the fullest extent permitted by law.
Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated policy violations. You may close your account at any time from the in-app Settings page.
Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees paid by you in the 12 months preceding the claim. We exclude liability for indirect, consequential or special damages (including loss of profits, data, or goodwill), except where such exclusion is prohibited by law.
Governing law
These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by mandatory consumer law.
